LIMITED WARRANTY TERMS
1. General and duration
Without prejudice to the rights recognized to the consumer regarding the guarantee of conformity of the goods, as provided for by articles 128-135 of the Consumer Code (legislative decree 6 September 2005, n. 206), in consideration of the provisions of Mechane Srl. , based in Via Roncoduro 4, Cazzago di Pianiga VE), issues the following guarantee of conformity with reference to its products (the "Guarantee").
This Warranty is automatically activated from the date of delivery of the vehicle and covers any lack of conformity that may occur within two years from the date of delivery of the vehicle and which are reported by the consumer within two months from the date of discovery. , according to the provisions of art. 132 of the Consumer Code, with the sole exception of cases of non-compliance deriving from the relationship between consumer and final retailer.
The delivery date must be proven by a document issued by the seller or by another documentary evidence (e.g. receipt, invoice or delivery note) which shows the name of the seller, the delivery date of the equipment, the identification details of the same. (model type).
The battery of Mechane electric vehicles has a limited warranty of 12 months, sufficient time to detect any conformity and / or production defects. For no reason the extension of the warranty on the battery to 24 months is allowed as it is an electrochemical organ subject to premature wear in case of negligence by the customer.
2. Conditions of validity of the Guarantee
The consumer loses his rights under this Warranty if he does not report the lack of conformity within two months from the discovery of the defect.
This Warranty operates on the condition that:
• the vehicle is used for personal use and therefore for purposes unrelated to the rental activity or any competitive activity carried out;
• all assembly operations are carried out by carefully following the instructions given in the instruction booklet and in any installation instruction documentation inserted inside the appliance;
• all vehicle use operations, as well as periodic maintenance, are carried out according to the prescriptions and indications given in the Instruction booklet;
• any repair work is carried out by personnel belonging to the network of technical assistance centers authorized by Mechane and only original spare parts are used.
3. Commitment to remedy the defect
In the event that the lack of conformity should appear during the validity of this guarantee, the consumer may request, at his choice, to repair the goods or to replace it, without charge in both cases, unless the requested remedy is not objectively impossible. or excessively burdensome compared to the other.
According to the art. 130 of the Consumer Code, the requested remedy is "excessively burdensome" if it imposes unreasonable expenses compared to the alternatives, taking into account the value that the asset would have if there was no lack of conformity, the extent of the lack of conformity, the possibility that the remedy can be carried out without significant inconvenience to the consumer.
For each request for intervention, the Consumer can dial the number 392 155 44 99 valid for calls from all over Italy, which will put him in contact with the nearest Authorized Technical Assistance Center.
It should be noted that to take advantage of the guarantee of conformity, the Consumer can directly contact the Mechane assistance channels, by calling the aforementioned number, regardless of the dealer where he purchased the vehicle.
Any repair or replacement of individual components or of the entire vehicle does not extend the duration of this Warranty which will therefore continue until the expiry of the two-year term as provided for in clause 1 above.
To improve service and reduce intervention times, customers are invited to provide the technical assistance center with the data of the vehicle in question. In particular, please provide the following information:
• equipment model (eg. Ermes)
• production number (eg # 01)
• date of purchase
• complained defect
4. Territorial extension of the Guarantee
Mechane vehicles were built to be used on private areas throughout the territory (including the Vatican City and the Republic of San Marino), while for use in public areas and on the road it is recommended to check any national, regional and local laws and regulations. The assistance is guaranteed through the network of repairers distributed throughout the Italian territory or through the collection of the product at the customer's Italian home.
5. Exclusion clauses
Interventions and / or repairs and / or any spare parts that may prove defective due to:
• failure to observe the instructions for use and maintenance given in the booklet supplied with the appliance;
• negligence and carelessness of use;
• incorrect assembly;
• maintenance or repairs carried out by unauthorized personnel and / or use of non-original spare parts;
• transport damage, if not performed by Mechane, or defects caused by events that are not attributable to vehicle conformity defects;
The parts subject to normal wear and any accessories and consumables are also not covered by this Warranty, unless they are attributable to lack of conformity.
6. Limitation of Liability
Mechane declines all responsibility for any damage that may, directly or indirectly, derive to people or things as a consequence of the failure to comply with all the prescriptions indicated in the specific instruction booklet and concerning, in particular, those relating to assembly, use and maintenance of the vehicle.
7. Warranty Expiration
After the 24-month period of this Warranty, the cost of labor and spare parts for repairs will be borne by the consumer according to the rates applied from time to time by the technical assistance center.
8. Any conventional or additional warranties on the product
Any other guarantee offered on the product does not replace, limit or exclude or prejudice the consumer's right to activate this Guarantee of Conformity, nor does it in any way limit the rights provided for by the aforementioned articles. 128-135 of the Consumer Code.
TERMS OF TECHNICAL ASSISTANCE
MECHANE
To obtain assistance on Mechane electric vehicles in the event of a technical problem, please pay attention to the following instructions:
After making contact with our after-sales service and having received confirmation of taking charge, the goods must be sent to our warehouse and must be returned if possible in the original packaging, complete with all its parts (including packaging and any documentation and equipment accessory: manuals, cables, protective materials for components, etc.).
If the original box is not present, the shipping packaging must be able to be used for subsequent shipping at the end of the repair, otherwise € 10.00 will be charged for new packaging.
The shipment from the customer to our warehouse is charged to the customer and is at his own risk and peril, so in case of loss or damage in the transport of the item / s, Mechane is not liable for any reason.
The vehicle or product purchased from us must not have undergone any repairs or any similar attempts by the customer, except for routine maintenance (replacement / repair of tires / inner tubes, brake pads and cables, chains and belts, oil and liquids), in the event of this occurring, 50.00 euros will be strictly charged with a debit note for zero technical intervention by our staff.
The product sent to our warehouse will be taken over, opened a ticket, and verified.
The assistance ticket costs € 50.00.
Following verification of whether the problem is attributable to a malfunction of the product still under warranty, no ticket opening and repair costs will be charged to the customer.
If the problem is attributable to vehicle wear (chains, belts, brake pads, batteries, cables and sheaths), to spare parts not covered by the warranty (tires, inner tubes, valves) or to damage caused by the customer, the assistance ticket will be opened and a repair estimate will be made. In the event that the estimate is not accepted, the cost of opening the ticket will still be invoiced.
If no problem is found on the product, the customer will be charged the ticket opening cost for null technical intervention by our staff.
In the event of null intervention and out-of-warranty repairs, the return shipping costs will be charged to the customer.
The times for repairing the products are estimated at approximately 20 working days from receipt of the product.
The validity of the warranty after assistance has a duration of 30 days for products sold by Mechane that have suffered damage not attributable to product defects.
